Family roots is a residence authorization for exceptional circumstances that grants the ability to live and work in Spain to non-EU foreigners who can demonstrate a link with a Spanish citizen.

 

What kind of authorization is Family Roots?

Family Roots, a temporary residence authorization for exceptional circumstances that may be granted to foreign citizens who are in Spain and are either the father or mother of a minor of Spanish or Community nationality, or are the children of a father or mother who were originally Spanish.

This type of residence permit is characterized by having a duration of one year, and during all this time you will be able to reside and work in Spain both for your own account and for someone else.

Like any other residence and work permit, once it is close to expiration, you must renew it to be able to continue in Spain completely legally.

 

Requirements for Family Rooting:

1. Not be a citizen of a State of the European Union, the European Economic Area or Switzerland, or a family member of citizens of these countries to which the Union citizen regime applies.

2. Lack of criminal records in Spain and in their previous countries of residence for crimes existing in the Spanish legal system.

3. Not being prohibited from entering Spain and not appearing as rejectable in the territorial space of countries with which Spain has signed an agreement to that effect.

4. Being in any of these cases:

a) In the case of the father or mother, or guardian of a minor of Spanish nationality, providing that the applicant parent or guardian is in charge of  the minor or is aware of the child obligations. Likewise, in the case of a person who provides support to a person of Spanish nationality with a disability, for the exercise of their legal capacity, providing that the applicant who provides such support has a position for the person with a disability. In this case, an authorization will be granted for five years that enables them to work for others and for their own account.

b) In the case of the spouse or accredited common-law partner of a citizen of Spanish nationality. Also in the case of dependent ascendants over 65 years old, or under 65 years old, dependent descendants under 21 years old, or over 21 years old, of Spanish nationality, or of their spouse or common-law partner. An authorization will be granted for five years that enables them to work for others and for themselves.

c) In the case of children of a father or mother who were originally Spanish.

 

Where do I apply for Family Roots?

The application for the Residence Authorization for Exceptional Circumstances for Family Roots must be submitted to the Immigration Office where you have your domicile.

You can process this permit yourself or through a lawyer, administrative manager or social graduate (online).

Documentation to request Family Roots.

1. Official model application form (EX-10) in duplicate, duly completed and signed by the foreigner.

2. Complete copy of the passport, travel document or registration document with a minimum validity of four months.

3. Criminal record certificate issued by the Authorities of the country or countries in which you have resided during the last five years prior to entering Spain.

4. Documentation accrediting the family relationship and nationality.

5. Pay the fee 790 code 052.

You must bear in mind that any document that is issued outside of Spain must be legalized or apostilled.
